1. Parties
This Equipment Lease ("Lease") is entered into between Cam Club 305 (Alnika Group LLC) ("Lessor") and you, the customer ("Lessee"), collectively the "Parties." By electronically signing this agreement, or by completing payment, Lessee agrees to be bound by these terms, whether or not Lessee has read them. Lessor may modify these terms at any time and any modification becomes effective immediately upon posting.
2. Purpose
Lessee wishes to hire Lessor to provide video camcorder rental services for Lessee's event. The physical items Lessor provides are referred to as "Equipment."
3. Lease & Term
Lessor leases the camcorder, tapes, charger, and accessories shown on the booking invoice to Lessee for a 4-day rental window (extendable via add-on). The term begins on the day of pickup or first delivery attempt and expires 72 hours after the event start date. Equipment must be returned by the end of the rental window using the method specified by Lessor (free Miami pickup & drop-off unless otherwise arranged).
4. Rent & Payment
All rent and add-ons are paid in advance, in full, before the rental begins. The booking retainer is 100% of the order total and is non-refundable, irrespective of payment method. Lessee agrees this fee fairly compensates Lessor for committing the Equipment and turning down other potential bookings for the same window.
5. Use & Care
Lessee shall use the Equipment in a careful, safe, and lawful manner and shall comply with all applicable laws and manufacturer instructions. Lessee shall not attempt to repair or modify the Equipment. Lessee must keep the Equipment clean; Lessor may charge a Cleaning Fee for Equipment returned dirty in Lessor's sole judgment.
6. Age
Lessor will not rent Equipment to anyone under the age of 18. Lessee agrees not to allow anyone under 18 to pick up or return the Equipment.
7. Loss & Damage
Lessee assumes the entire risk of loss and damage to the Equipment from any cause whatsoever during the rental period. In the event of damage, Lessor may charge Lessee's card on file for the full cost of repair (up to $900) plus a Loss of Use Fee equal to the daily rental Lessor would have earned for the days the Equipment is out of service. If the Equipment is damaged beyond repair or lost, Lessee shall pay the full replacement value of the Equipment.
8. Non-Working Equipment
Lessee shall notify Lessor promptly of any malfunction. Lessor will either provide a working replacement or, at Lessee's option, refund the rental charges paid. Lessee must not attempt to repair the Equipment.
9. Refunds (Video Guarantee)
A full refund is available only under the Cam Club 305 (Alnika Group LLC) Video Guarantee: (1) Equipment is confirmed defective and caused the failure; (2) Lessee captured no footage despite following all setup instructions properly and the Equipment was in working order; (3) the package is lost in transit. The guarantee does NOT cover: user error, failure to power on or charge the Equipment, failure to return the Equipment, cancellations, or any damage during Lessee's possession.
10. Cancellation, Rescheduling & No-Shows
If Lessee cancels, reschedules, or no-shows, Lessor is not obligated to refund any monies already paid and is not obligated to fill the void created. If Lessor is able to re-book the window with another client, Lessor may, in its sole discretion, excuse all or a portion of the outstanding balance.
11. Delivery of Editing Services
Lessor will use reasonable efforts to deliver the edited 2–3 minute mini-movie within 2 weeks after the event date, but reserves up to 16 weeks for delivery in the event of unusual workload or technical issues.
12. Copyright & Permitted Use
Lessor owns all copyright in any edited work(s) produced under this agreement. Lessor grants Lessee a non-exclusive license to use the delivered video for personal, non-commercial use on Lessee's personal social media and personal website, with attribution to Cam Club 305 (Alnika Group LLC).
13. Force Majeure
Lessor will not be liable for failure to perform due to strikes, calamities, acts of God, fire, flood, pandemic, hurricane, or any other event outside Lessor's control, for so long as such event continues and for a reasonable time thereafter.
14. Artistic Release
Editing and shooting style are subjective. Lessor will use reasonable efforts to incorporate Lessee's suggestions but retains final aesthetic judgment. Dissatisfaction with artistic style is not a valid reason for termination or refund.
15. Limit of Liability
Lessor's maximum liability under this agreement is limited to the total rent paid by Lessee. Lessee shall indemnify and hold Lessor harmless from any claims arising out of Lessee's possession, use, operation, or return of the Equipment.
16. Governing Law & Venue
This agreement is governed by the laws of the State of Florida. Any legal proceeding shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
17. Entire Agreement
This agreement, together with the booking invoice, contains the entire understanding between the Parties and supersedes any prior agreements. If any provision is held unenforceable, the remainder remains in full force.
